Photold Terms of Use

These Terms of Use ("Terms") form a legally binding agreement between you ("you", "your") and Pace Tech ("Pace Tech", "we", "us" or "our") and govern your access to and use of the Photold mobile application and any related services, updates, content and documentation (collectively, the "App").

1. Eligibility

You must be at least 13 years old (or 16 years old in the European Economic Area, the United Kingdom and any other jurisdiction with a higher minimum age) to use the App. If you are below the legal age of majority in your jurisdiction, you represent that you have obtained the verifiable consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. The App is not intended for, and may not be used by, persons in jurisdictions or on government lists where its use would be unlawful.

You further represent that you (a) are not located in, and are not a national of, any country subject to a comprehensive U.S. Government embargo or otherwise designated as a "terrorist supporting" country; and (b) are not listed on any U.S. Government list of prohibited or restricted parties (including the OFAC SDN list).

2. License Grant

Subject to your continued compliance with these Terms, Pace Tech grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and install the App on devices that you own or control, and to use the App for your personal, non-commercial purposes, in accordance with the usage rules of the platform from which you obtained it (Apple App Store or Google Play).

This license is granted, not sold. Pace Tech and its licensors retain all right, title and interest in and to the App, including all related intellectual property rights. No rights are granted to you by implication, estoppel or otherwise except as expressly set out in these Terms.

You may not, and you may not permit any third party to:

• sell, resell, rent, lease, sublicense, distribute, publish, transmit or otherwise commercially exploit the App;
• copy, modify, adapt, translate, create derivative works of, decompile, reverse engineer, disassemble or attempt to derive the source code, algorithms, structure or organization of the App, except to the extent these restrictions are expressly prohibited by applicable mandatory law;
• remove, obscure or alter any proprietary notice, label or mark contained in or on the App;
• use any data mining, robot or similar data-gathering or extraction method on the App;
• interfere with, disrupt, attempt to gain unauthorized access to, probe or test the security of, or impose an unreasonable load on the App or the third-party services it depends on;
• circumvent, bypass or attempt to bypass any rate limit, paywall, license check, region restriction or other access control;
• use the App to develop a competing product or service, to train a competing machine-learning model, or to benchmark the App for any of the foregoing purposes; or
• use the App in violation of any applicable law, regulation or third-party right.

3. Your Content and AI Features (Colorize & Restore)

3.1 Ownership of Your Content

You retain all right, title and interest in and to the photographs, images and other content that you scan, import, edit, save or share through the App ("Your Content"). Pace Tech does not claim any ownership interest in Your Content.

3.2 Limited License to Pace Tech

Solely to the extent necessary to provide the App's functionality to you, you grant Pace Tech a worldwide, royalty-free, fully paid-up, non-exclusive license to read, decode, transcode, transform, display and otherwise process Your Content on your device, and — when and only when you tap the Colorize with AI or Restore with AI button (each, an "AI Feature") — to transmit a single copy of the relevant image to Google's Gemini API on your behalf. This license terminates automatically when the App finishes processing the relevant image.

3.3 Your Representations Regarding Your Content

You represent and warrant that, with respect to each item of Your Content:

• you own it outright or you hold all licenses, rights, consents, releases and permissions necessary to scan, edit, process, transmit, store and share it through the App and (where applicable) through Google's Gemini API;
• it does not, and your use of the App in connection with it does not, infringe, misappropriate or violate any patent, copyright, trademark, trade secret, moral right, right of publicity, right of privacy or other intellectual-property or proprietary right of any third party, or any applicable law;
• it does not contain, and you will not use the App to process, any of the following: child sexual abuse material; non-consensual intimate imagery; content depicting or facilitating real-world violence, terrorism, hate speech or harassment; defamatory or fraudulent content; content that infringes intellectual-property rights; or content that is otherwise unlawful in any jurisdiction in which the content is captured, transmitted or viewed.

You are solely and entirely responsible for Your Content and for the consequences of capturing, processing, saving, transmitting and sharing it through the App.

3.4 AI Features — Acknowledgments and Assumption of Risk

The Colorize with AI and Restore with AI features are provided solely as an opt-in convenience for personal entertainment and archival purposes. By tapping either button, you irrevocably acknowledge and agree that:

• the relevant image is transmitted to Google LLC's Gemini API for processing on infrastructure that Pace Tech does not own, control, audit or supervise;
• Google's processing is governed by Google's own terms, including the Generative AI Prohibited Use Policy, and Pace Tech is not a party to that relationship and has no power to enforce it on your behalf;
• the colorized or restored output is generated by a probabilistic machine-learning model and may contain inaccuracies, hallucinated detail, historically inappropriate colors, color shifts, artifacts, altered facial features or other defects, and must not be relied upon as a faithful or historically accurate restoration;
• Pace Tech makes no representation that the colorization or restoration will be of any particular quality, accuracy, fitness, durability or aesthetic appeal;
• you assume all risks associated with submitting Your Content to a third-party AI service, including the risk of misclassification, misuse, breach, retention, training-set inclusion or international transfer by that third party.

If you do not accept these acknowledgments, do not tap the Colorize or Restore buttons.

3.5 AI Usage Limits, Subscription Tiers and Regional Variation

The number of AI Colorize and AI Restore operations you may perform is subject to usage allowances (for example, daily, weekly or monthly caps, or a fixed credit balance) that vary by subscription package and that may also vary by country, region or storefront. Free users are subject to a lower allowance than paid users, and different paid tiers (for example, weekly, monthly or yearly plans) may offer different allowances. The App Store / Google Play storefront associated with your account, local pricing, local regulatory requirements and A/B testing may all cause the same nominal package to carry a different allowance in different markets.

Pace Tech does not commit to any specific number of AI Colorize or AI Restore operations in these Terms. No figure set out in marketing, screenshots, reviews, third-party articles or any earlier version of the App is guaranteed. The only allowance that applies to your account at any given time is the one actually displayed inside the App and/or in the App Store / Google Play listing for the package you have purchased in your country at that time.

You acknowledge and agree that Pace Tech may, at its sole discretion and without notice:

• introduce, increase, reduce or remove the number of AI Colorize or AI Restore operations included in any free or paid tier, in any country or region;
• offer different allowances, prices, trials or bundles in different countries, regions or storefronts;
• change the billing period (daily / weekly / monthly / yearly), reset cadence or carry-over behavior of any allowance;
• introduce overage charges, per-operation pricing or additional credit packs;
• throttle, queue, delay or temporarily suspend AI operations to preserve service stability, comply with local law or manage costs; and
• modify, deprecate or discontinue the AI Colorize feature, the AI Restore feature or any individual subscription tier, in any country or globally.

Changes to allowances or pricing take effect as posted in the App or in the App Store / Google Play listing and apply to the next billing cycle for existing subscribers (or immediately for one-time purchases or free users), except where mandatory law requires otherwise. If you do not accept a change, your sole and exclusive remedy is to cancel your subscription through your app store account and stop using the relevant AI feature.

3.6 No Backup Service

The App is not a backup service. Pace Tech does not store Your Content on any infrastructure it owns, and has no ability to restore Your Content if it is lost, deleted, corrupted or overwritten. You are solely responsible for maintaining your own backups of Your Content.

4. Acceptable Use

In addition to the prohibitions in Section 2, you agree not to use the App, or permit it to be used, to:

• create, process, store or transmit material that violates any applicable law (civil or criminal), including export-control, sanctions, anti-money-laundering, anti-terrorism and child-protection laws;
• impersonate any person or entity or misrepresent your affiliation with any person or entity;
• generate, process or distribute deceptive, defamatory, harassing, threatening, hateful or pornographic material, or material that depicts or facilitates real-world harm;
• attempt to derive personal information from photographs of identifiable individuals without their consent;
• train any machine-learning model, dataset or system using outputs of the App;
• interfere with the integrity, performance or security of the App or any service the App relies on; or
• facilitate or encourage any of the foregoing.

We may, at our sole and absolute discretion and without notice, refuse, restrict, suspend, throttle or terminate access to the App or to any feature (including AI Colorize and AI Restore) where we reasonably suspect a violation of these Terms or of applicable law, or where doing so is necessary to protect Pace Tech, our service providers or other users.

5. Intellectual Property

The App, including its software, source code, object code, design, graphics, icons, animations, copy, layout, branding and aggregate look-and-feel, together with all related improvements, modifications and derivative works, is owned by Pace Tech and/or its licensors and is protected by copyright, trademark, trade-secret and other intellectual-property laws of Türkiye, the United States, the European Union, the United Kingdom and other jurisdictions. The license granted in Section 2 conveys no ownership rights to you.

"Photold", the Photold logo and any related marks are trademarks of Pace Tech. All other marks are the property of their respective owners. You may not use any of our trademarks without our prior written permission.

The App incorporates third-party open-source components. Each such component is licensed to you under its own license, the terms of which prevail over these Terms with respect to that component to the extent of any conflict. A list of components and their licenses is available within the App's "About" section or by request to info@pacetech.co.

5.1 DMCA / Copyright Notices

If you believe that material accessible through the App infringes a copyright that you own or control, please send a written notice to info@pacetech.co containing:

• a physical or electronic signature of the person authorized to act on behalf of the copyright owner;
• identification of the copyrighted work claimed to be infringed;
• identification of the allegedly infringing material and its location, sufficient to permit us to locate it;
• your contact information;
• a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
• a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or are authorized to act on the owner's behalf.

We will respond to substantially compliant notices in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512) and applicable analogous laws.

6. Third-Party Services

The App relies on services provided by third parties, including:

• Apple Inc. (App Store distribution; VisionKit document scanner on iOS);
• Google LLC (Google Play distribution; ML Kit Document Scanner on Android; the Gemini API for AI Colorize and AI Restore);
• the device operating system itself.

Your use of any third-party service is governed by that party's own terms and privacy policy. Pace Tech is not responsible for the availability, functionality, accuracy, reliability, content, security, lawfulness or any other aspect of any third-party service, and Pace Tech disclaims all liability arising out of or in any way connected with such services, to the maximum extent permitted by applicable law.

7. Subscriptions, In-App Purchases and Pricing

The App may, in current or future versions, offer optional paid features, in-app purchases or subscriptions. Where it does so:

• all transactions are processed by your device's app store (Apple App Store or Google Play) and are subject to that store's billing terms; Pace Tech does not collect, store or process payment-card information directly;
• subscriptions auto-renew at the then-current price unless you cancel through your store account at least 24 hours before the end of the current billing period;
• you may cancel through your store account at any time; cancellation takes effect at the end of the current paid period; and
• refunds are governed by the relevant store's refund policy. Except where required by mandatory law, all sales are final and non-refundable by Pace Tech.

Pace Tech may modify pricing, payment models, free quotas, per-tier AI Colorize and AI Restore allowances (see Section 3.5), trial periods and feature bundling at any time, with such changes effective for purchases made after the change is posted in the App or in the App Store/Play listing. The per-tier limits that apply to you are those displayed in the App and/or store listing for your current package.

8. Updates and Changes to the App

Pace Tech may, at its sole discretion and without notice, modify, update, suspend, discontinue or remove the App, any feature or any portion thereof, including for reasons related to security, performance, third-party-service availability, legal compliance, commercial viability or product strategy. Such modification or discontinuation may occur with or without prior notice and may be permanent. Pace Tech shall have no liability to you or to any third party for any modification, suspension or discontinuation.

9. Beta and Experimental Features

From time to time, the App may include features that are clearly designated as "beta", "preview", "experimental", "early access" or similar (each, a "Beta Feature"). Beta Features are provided "AS IS", may contain bugs, may produce inaccurate results and may be modified or removed at any time. You use Beta Features at your own risk. Pace Tech disclaims all warranties and all liability for Beta Features to the maximum extent permitted by applicable law.

10. Suspension and Termination

These Terms remain in effect until terminated. You may terminate them at any time by deleting the App from all of your devices.

Pace Tech may, at its sole and absolute discretion, with or without cause and with or without notice, suspend or terminate your access to the App or to any feature or content within it, in whole or in part, at any time. Without limiting the foregoing, Pace Tech may take such action where it reasonably believes you have violated these Terms or any applicable law, or where required to protect Pace Tech, the App, our service providers or other users.

Upon termination, your license under Section 2 ends immediately and you must promptly cease all use of the App and delete all copies in your possession. Sections that by their nature should survive termination, including Sections 3.3, 3.4, 3.5, 3.6, 4, 5, 11, 12, 13, 14, 17, 18 and 19, will survive.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PACE TECH AND ITS OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS AND SERVICE PROVIDERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, INTEGRATION, SYSTEM INTEGRATION OR ANY WARRANTY ARISING FROM A COURSE OF DEALING, USAGE OR TRADE PRACTICE.

Without limiting the foregoing, Pace Tech does not warrant that: (a) the App will meet your requirements; (b) the App will operate uninterrupted, error-free or securely; (c) any defects will be corrected; (d) the App, its outputs or the servers that make the App available are free of viruses or harmful components; (e) the App, any output or any data obtained through the App will be accurate, current, reliable, complete, useful or safe; or (f) the App will be compatible with any third-party software, hardware or service.

No advice or information, whether oral or written, obtained from Pace Tech or through the App, shall create any warranty not expressly made in these Terms.

Some jurisdictions do not allow the exclusion of certain implied warranties or limitations on how long an implied warranty lasts. In such jurisdictions, the exclusions and limitations above apply to the maximum extent permitted by applicable law, and any implied warranty that cannot be disclaimed is limited to ninety (90) days from the date you first installed the App.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PACE TECH OR ITS OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS OR SERVICE PROVIDERS BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION:

• lost profits, lost revenue, lost business opportunities or lost savings;
• loss or corruption of data, images, memories or content;
• cost of procurement of substitute goods or services;
• damage to reputation, goodwill or emotional distress;
• damages arising from or related to any inaccurate, offensive or unintended output of the AI Colorize or AI Restore features;
• damages arising from any third-party service, including Google's Gemini API; or
• damages arising from your use of, or inability to use, the App or any output generated through it,

even if Pace Tech has been advised of the possibility of such damages and regardless of the legal theory asserted (including contract, tort, strict liability, negligence or any other theory).

Without limiting the foregoing, Pace Tech's total cumulative liability arising out of or relating to these Terms or the App, for any cause whatsoever, shall not exceed the greater of (i) the aggregate amount you actually paid Pace Tech (net of fees retained by app stores and payment processors) for the App in the six (6) months immediately preceding the event giving rise to liability, or (ii) United States Dollars Twenty-Five (US $25.00).

The limitations and exclusions in this Section 12 (a) form an essential basis of the bargain between you and Pace Tech and apply even if any limited remedy is found to have failed of its essential purpose, and (b) do not limit any liability that, under applicable mandatory law, cannot be limited (for example, in some jurisdictions, liability for gross negligence, fraud, willful misconduct, death or personal injury).

13. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify and hold harmless Pace Tech and its officers, directors, employees, agents, affiliates, contractors, licensors and service providers (each, an "Indemnified Party") from and against any and all claims, demands, actions, losses, liabilities, damages, judgments, settlements, costs and expenses (including reasonable attorneys' fees) (collectively, "Claims") arising out of or relating to:

• Your Content, including any allegation that Your Content infringes any intellectual-property right, publicity right, privacy right or other right of any third party, or violates any law;
• your access to, use or misuse of the App;
• your violation of these Terms, of any applicable law or of any third-party right; or
• any image you submit to Google's Gemini API through the AI Colorize or AI Restore features.

Pace Tech reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of those Claims. You agree not to settle any Claim without Pace Tech's prior written consent. This Section 13 will survive termination of these Terms.

14. Force Majeure

Pace Tech shall not be liable for any failure or delay in performance under these Terms to the extent caused by circumstances beyond its reasonable control, including without limitation acts of God, natural disaster, pandemic, war, civil unrest, terrorism, government action, sanctions, embargoes, internet or telecommunications outage, third-party service failure (including any disruption of Google's Gemini API or any app store), labor dispute, fire, flood or earthquake.

15. Apple App Store-Specific Terms

This Section 15 applies if you obtained the App from the Apple App Store. To the extent of any conflict between these Terms and Apple's Licensed Application End User License Agreement, these Terms control, except to the extent required by Apple's policies.

• Acknowledgment. You and Pace Tech acknowledge that these Terms are concluded between you and Pace Tech only, and not with Apple Inc. ("Apple"). Pace Tech, not Apple, is solely responsible for the App and its content.
• Scope of License. The license granted in these Terms is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules of the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
• Maintenance and Support. Pace Tech, and not Apple, is solely responsible for providing any maintenance and support for the App. You and Pace Tech acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• Warranty. Pace Tech is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any); to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Pace Tech's sole responsibility.
• Product Claims. You and Pace Tech acknowledge that, as between Apple and Pace Tech, Pace Tech, not Apple, is responsible for addressing any claims of you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation, including in connection with the App's use of HealthKit, HomeKit or similar Apple frameworks (none of which are used by Photold).
• Intellectual-Property Rights. You and Pace Tech acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Pace Tech, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual-property infringement claim.
• Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Beneficiary. You and Pace Tech acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

16. Google Play-Specific Terms

This Section 16 applies if you obtained the App from Google Play. Your use of the App through Google Play is also subject to the Google Play Terms of Service. As between you and Pace Tech, Pace Tech is solely responsible for the App.

17. Governing Law and Forum (Non-U.S. Users)

These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by, and shall be construed in accordance with, the laws of the Republic of Türkiye, without regard to its conflict-of-laws principles.

Subject to Section 18 (which applies to U.S. residents) and to any mandatory consumer-protection rights you may have, the courts and execution offices of Istanbul (Çağlayan), Türkiye shall have exclusive jurisdiction to settle any dispute, controversy or claim arising out of or in connection with these Terms or the App, including any question regarding their existence, validity or termination.

If you are a consumer resident in the European Economic Area, the United Kingdom, Switzerland or another jurisdiction whose mandatory consumer-protection law affords you the right to bring proceedings in your country of residence, nothing in this Section 17 deprives you of that right.

18. Binding Arbitration and Class-Action Waiver (U.S. Residents)

This Section 18 applies to you if you are a resident of, or your principal place of business is in, the United States or any of its territories.

• Binding Arbitration. You and Pace Tech agree that any and all disputes, claims or controversies arising out of or relating to these Terms, the App or your use of the App (each, a "Dispute") shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect, except that either party may bring an individual action in small-claims court for disputes within that court's jurisdiction. The arbitration shall be conducted in the English language, on a documents-only basis where permitted, and the seat of the arbitration shall be New York, New York. Judgment on any award may be entered in any court of competent jurisdiction.
• Class-Action Waiver. YOU AND PACE TECH AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, MASS OR PRIVATE-ATTORNEY-GENERAL ACTION OR PROCEEDING. Unless both parties expressly agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
• Opt-Out. You may opt out of this Section 18 by sending written notice to info@pacetech.co with the subject line "Photold — Arbitration Opt-Out" within thirty (30) days after first accepting these Terms. The notice must include your full name, the email address associated with your device's app store account and a clear statement that you wish to opt out. Opting out of this Section 18 will not affect any other portion of these Terms.
• Severability. If any portion of this Section 18 (other than the class-action waiver) is found to be unenforceable, that portion shall be severed and the remainder of this Section 18 shall remain in effect. If the class-action waiver is found to be unenforceable, then the entirety of this Section 18 shall be void.

19. General Provisions

• Entire Agreement. These Terms (together with the Privacy Policy and any additional terms expressly incorporated by reference) constitute the entire agreement between you and Pace Tech with respect to the App and supersede all prior or contemporaneous agreements, communications and understandings, whether oral or written, with respect to the subject matter hereof.
• No Waiver. No failure or delay by Pace Tech to enforce any provision of these Terms shall operate as a waiver of that or any other provision. A waiver is effective only if expressly given in writing by an authorized representative of Pace Tech.
• Severability. If any provision of these Terms is held invalid, illegal or unenforceable by a court of competent jurisdiction or arbitrator, the remaining provisions shall remain in full force and effect, and the invalid provision shall be reformed to the minimum extent necessary to make it valid, legal and enforceable while reflecting as closely as possible the original intent.
• Assignment. You may not assign, transfer or delegate any of your rights or obligations under these Terms, by operation of law or otherwise, without Pace Tech's prior written consent. Pace Tech may freely assign or transfer these Terms in whole or in part, including in connection with a merger, acquisition, financing, reorganization or sale of all or substantially all of its assets. Any purported assignment in violation of this clause is null and void.
• Notices. Pace Tech may give notice by means of a general notice in the App, by an in-App message, by an email to any address you have provided to Pace Tech, or by an update to these Terms. You may contact Pace Tech at info@pacetech.co.
• Relationship. Nothing in these Terms shall be construed as creating any agency, partnership, joint venture, fiduciary, employment or franchise relationship between you and Pace Tech.
• Headings. The section headings used in these Terms are for convenience only and shall not affect the interpretation of any provision.
• Language. These Terms are concluded in English. Any translation provided for convenience shall not be binding; in the event of any conflict between the English version and a translation, the English version controls.
• Changes. Pace Tech may revise these Terms from time to time. The "Effective date" and "Last updated" lines at the top reflect the current revision. Material changes will be communicated through the App's release notes or through an in-App notice. Your continued use of the App after a revised version becomes effective constitutes your acceptance of the revised Terms. If you do not accept a revision, your sole and exclusive remedy is to stop using the App and uninstall it.
